Lavra is accused of allegedly maintaining property in improper condition

On July 5, 2023, another preparatory hearing was held in the case of the Monastery’s lawsuit against the reserve to invalidate the unilateral termination of the Agreement under which Lavra has used and continues to use the houses of worship for services, lawyer Nikita Chekman reported on his Telegram page.
The monastery is accused of allegedly violating the terms of the Contract — maintained the property in improper condition and carried out its misuse.
Since the inspections were carried out not by the reserve, but by the Ministry of Culture and Information Policy of Ukraine, a petition was filed for the appointment of a construction technical expertise.
According to the lawyer, persons who are not specialists in the field of urban planning can not objectively determine whether the Monastery really violated the urban planning regulations and kept the buildings in an improper condition.
However, the Court sees no need for this expert examination, «without which, in fact, it cannot fully and comprehensively review the said case.
