Court denies Volodymyr-Volyn Diocese of the UOC the right to review the decision to evict from the Cathedral

On April 24, 2025, the Economic Court of Volyn Region held a regular hearing in the case of the eviction of the Volodymyr-Volyn Diocese of the Ukrainian Orthodox Church from the complex of premises of the Holy Dormition Cathedral in Volodymyr-Volynskyi, which also houses the diocesan administration and the Volodymyr-Volynskyi Theological School. This time, the diocese’s lawyers filed a petition to review the decision due to the fact that the text contained errors in the legal name of the religious organization. However, the court rejected the diocese’s claim. This was reported by the regional publication Bug.
It is reported that in court, representatives of the Volodymyr-Volyn Diocese of the UOC filed a petition to overturn the decision of the Northwestern Economic Court of Appeal of March 11 on eviction, relying on a technical error in the documents. It turned out that instead of the words “religious organization,” the court documents stated “religious community.”
However, the court ruled that such an inaccuracy did not affect the merits of the case, as the name of the party and its other important identification data were correct. Therefore, the petition of the Volodymyr-Volyn Diocese of the UOC to cancel the decision due to a technical error was rejected, and the eviction decision remains in force.
Earlier, we reported that the Volodymyr-Volyn Diocese of the Ukrainian Orthodox Church filed a petition with the Economic Court of Volyn Region to extend the deadline for eviction from the Holy Dormition Cathedral complex, which houses the diocesan administration and theological school. In the petition, the diocesan lawyer motivates this request by the fact that the Church needs time to remove all its property from the premises expropriated by the state.
