Court rejects UOC community’s appeal in case of arrest of Assumption Cathedral in Volodymyr-Volynskyi

On August 7, the Northern Appeals Commercial Court in Kyiv considered the appeal filed by the religious community of the Ukrainian Orthodox Church against the decision of the court of first instance regarding the arrest of the building of the Assumption Cathedral and the bell tower in the city of Volodymyr-Volynskyi. This was reported by Suspilne Lutsk.
According to a phone comment to Suspilne by Oleksandr Hargola, head of the legal department of the regional state administration, representatives of the UOC community sought to prohibit the regional state administration and the state registrar from performing any actions related to this property. In particular, from signing acceptance-transfer acts, alienating, or transferring it for use by third parties.
The court dismissed the appeal and upheld the refusal to grant injunction. Thus, the state is not prohibited from carrying out registration actions, and the community itself, according to the court, did not prove a violation of its rights.
The decision can be appealed to the Cassation Commercial Court.
Recall that the Supreme Court of Ukraine rejected the cassation appeal of the religious community of the Ukrainian Orthodox Church regarding the right to use the Holy Assumption Cathedral in Volodymyr-Volynskyi. On July 8, Member of Parliament Ihor Huz announced this, commenting on the conclusion of the court process. The MP stated that events might develop in two directions: “They will pack their things humanely and leave on their own. They will again come up with something, block, delay. Then the community and the relevant structures may help them here,” — the MP noted, effectively allowing for the possibility of forceful intervention by local activists or authorities in case the UOC refuses to voluntarily vacate the cathedral.
