Court in Ivano-Frankivsk overturns city council's appeal to ban abortions

Ivano-Frankivsk District Administrative Court satisfied the lawsuit of local resident Olha Kukula and canceled the decision of the city council, which called on the highest authorities of Ukraine to ban abortions at the constitutional level. The court recognized that the city council, by adopting such an appeal, had exceeded its legal authority.
According to zaxid.net, the decision was made on October 29. In the lawsuit Olga Kukula insisted that the appeal of the deputies is illegal, discriminatory and represents an interference in the rights of women. In addition, the basis for its adoption was a letter from the Ivano-Frankivsk Archdiocese of the UGCC, which did not specify to whom it was addressed.
Having considered the case, the court concluded that the city council acted outside the exclusive competence of the local government body. «Based on the legally enshrined powers of the city council, they do not include proposing bills,» the official court ruling said.
Thus, the appeal of Ivano-Frankivsk city Council to the President, Verkhovna Rada and the Cabinet of Ministers of Ukraine with a call to amend the Constitution to ban abortions was recognized illegal and canceled in court.
